The following has happened to me in two department stores in Bangkok and I wonder if it is legal.

First it was in Siam Paragon where I wanted to buy three shirts
and that would give me 30% discount. When we were about to go to the cashier I realized that I did not have my passport number with me so I could not fill out the form for the 7% tax
refund. So I told the lady who was working there about the
problem and asked her to keep the shirts for me until the day
after so that I could bring my passport with me. She said if I
pay cash she can give me additional 10% discount so that would
compensate for not getting tax refund. First I thought it was OK
but since I did not have that much cash on me (about 3500 THB) I went out and took out money from an ATM outside and came back. Then I said to her that we could go the cashier now but she said no I have to pay directly to her but I won't get any
receipt! I was really surprised and said what happens then if the
security asks me about the receipt when I leave the store? She
said no, you just say that you had exchanged the shirts and it
won't be any problem. I declined and left the store without
buying anything.

The funny thing is that exactly the same thing happened after a
couple of days when I wanted to buy something else at a Central
department store. Actually that time I was with a Thai friend and
I asked her if this was legal and she said it would be OK to do
so.

Sorry for the long story but I wonder if anyone else has had
a similar experience. Is this really legal?

Sounds a little flakey to me.....
the usual method....you pick out merchandise, and hand it to the person that has been hovering around you for the last 25 minutes....she hands the goods to another sales rep that walks with the goods to the cashier table, handing the product to the person behind the counter. That person inspects the items, makes some comments and hands the stuff to the chashier who, in turn, rings up the prices. The items are then handed to the other person behind the counter who hands the things to a third person and then your items are put into the bag. The cashier hands you your receipt and you go merrily on your way....

I can't help thinking that if something goes wrong they might even deny that they have received the money from you.

Was at the Dim Sum place in MBK, counted about 40 staff, 4 customers, and observed a girl with a "Trainee" badge on, who was being shown how to wipe a table by a control freak... sad

You really don't understand what's going on? You give her cash, she gives you no receipt, she pockets the cash (more than her weekly pay), and no one is the wiser. Until a month later when inventory tallys 3 shirts missing.

Duhhhhhhhhhhhhhhh...

Why do you think stores have signs at cash registers that say: "If you don't get a receipt your purchase is free!"? To make sure that the cashier rings up every purchase and doesn't pocket cash.

I thought that was common knowledge, but maybe not....

That was my guess and hence the reason to decline the offer. I live in Europe and that would obviously be illegal but after all TIT and I wanted to give them the benefit of the doubt...

... Thai department stores are not the same as western models... department stores here (and elsewhere throughout much of Asia) are actually a "mall within a mall"... while typical Thai department stores do have some of their own product, they also host a large number of "stores within their store."

... that's why there appears to be a bazillion employees in a department store... each employee works for their own "retail store"within the department store... none of whom will help you at the counter ("retail store") immediately adjoining their own little "retail store."

... these stores within the department store pay a base monthly rent to the department store, plus a percentage of their gross sales (a sizeable percentage, typically 35-40%, and northward for successful retailers)... the department store continually increases the percentage of gross sales rent until the retailer reaches their economic brink, at which time the department store stabilizes the percentage rent, allowing the retailer just enough profit to keep them there without killing them off.

... while percentage rent is common in the west, it is practiced nothing like these guys.

... this parasitic style of business places on the 'host' retailer all of the retailing risk... the 'parasitic' department store is no more than a landlord of a shopping mall filled with temporary leasees they bleed to the brink of bankruptcy, thus transferring the retail profits of their lesees to themselves in the form of rent.

... to prevent cheating by under-reporting sales, the department store does not permit the retailer to maintain their own cash registers... the retailers must submit all sales to the department store-operated cash registers... the department store keeps all of the retailers receipts, then distributes to the retailers their own share of their own sales at the end of the month, minus the hefty percentage rent.

... withholding receipts from the department store is risky, and easy to detect... perhaps a sign that the retailer is about to depart the department store, or is about to go under, and is liquidating inventory as fast as possible... nothing to lose.

... so... as suggested above, the clerk might have been seeking to scam the retailer for whom she worked... however... as a policy, the retailer itself might well be scamming the department store from their share of the percentage of sales rent (it's a big chunk of their profit).

... as always in Thailand, the rule is tourist beware... be VERY aware... even locals, as me, are always constantly vigilent and hyper-aware of how we will be scammed... the Land of Smiles deftly conceals a country whose cultural values are third-world sub-Sahara African.

... as a culture, Thailand is thoroughly corrupt... most everyone here lies to, steals from and cheats everyone else, so who really knows who was cheating who there?
